Non-Poaching Guarantee. Talent X will never poach the staff they place with Client no matter how long they have been in the role. 

REPLACEMENTS. Talent X’s intention is to find its clients valuable, productive staff members who stay long term. Talent X has a replacement structure:

Within 3 months of start date: FREE REPLACEMENT. This guarantee is applied for reasons such as: the candidate is not productive or reliable, not at the level you thought when you placed them, dishonest or causes friction within the team, leaves you for a similar role, leaves you for no reason, is fired for incompetence / non-performance or does not pass probation period. 

Client understands that this guarantee is void in the below circumstances, at which point 100% fee applies for replacement:

  • Candidate is made redundant, leaves for compassionate reasons, etc. but was otherwise a good employee who was productive and reliable.
  • Candidate is hired to fill a specific role, but ends up being put in other roles or the role is different than what was agreed which was their cause for leaving. 
  • Candidate is put into a role that simply is not doable. I.e. handling the workload of 3x full time roles, which was their cause for leaving. 
  • Candidate was not set up to succeed in the role. I.e. no or poor onboarding, neglection of the Candidate, and leaving them to figure things out without support, which was their cause for leaving. 
  • Candidate was promised something that was not received, only applicable to promises around role, pay, title, etc. which was their cause for leaving. 
  • Candidate was not managed properly, was treated poorly, etc, which was their cause for leaving.
  • Gross misconduct on behalf of the Client, which was their cause for leaving.

Between 3 – 6 months of start date: REPLACEMENT FOR 30% OF THE FIXED FEE

Between 6 – 9 months of start date: REPLACEMENT FOR 50% OF THE FIXED FEE

Between 9 – 12 months of start date: REPLACEMENT FOR 75% OF THE FIXED FEE
